تعريف

  • Abus, ce terme provient du latin abusus (du verbe abuti). Il signifie faire un usage excessif d' une prérogative juridique. Il s' agit donc pour le titulaire d' un droit , d' un pouvoir ou d' une fonction de sortir des normes qui régissent l' usage licite de leur exercice.

  • Abuso, proviene del latín abusus, que tiene como significado, uso excesivo. En derecho se entiende el mal uso o empleo arbitrario de la autoridad, la acción despótica de un poder, la consecuencia exagerada de un principio, el goce inmoderado de la propiedad o posesión; en definitiva, todo acto que, saliendo de los límites impuestos por la razón, la equidad, la justicia, ataque en forma directa o indirecta las leyes o el interés general.
